If you propose to find them a new tenant that they can screen before hand to either take over your lease or sign a new one year lease, they might go that route.

Id feel so terrible doing that to someone. Sticking them in that place. This is like the ring, where you have to get someone else balls deep in it to save yourself

Maybe you find someone who parties alot too or just is a really deep sleeper. Maybe the guys upstairs have a friend who parties with them all the time.

I'm a light sleeper too but no everyone out there is like that. I go visit my brother and he lives in the middle of a extremely busy area. He will sleep with the windows open and leave the tv or music cranked up, it doesn't phase him. When I go there I have to shut all the windows in his guest room and I'm constantly turning off all his stuff when he fall asleep. I still get woke up by the garbage trucks at 6am, all the traffic coming into the city, the homeless guys having an argument outside, etc. I've seen my brother take a nap in his room while there are like 10 people pre-gaming in his living room.

Just be upfront that if you are a light sleeper that this place isn't for you.

If they don't care about small claims court then I'll win, andx they will care, because 3 months rent is about 5 grand. And that's typically about 2 years profit on a single unit.

If best case scenario is I break my lease then I'm not being naive, I get my main goal. You also haven't explained why my case won't win.

Is the complex owned by a large corporation? If so, do you think they care about $5k? Like the amount of money is so minute to them. Even if you win, no one will notice at the top. Do what you want, but being in real estate I have seen similar law suites against HOA's and major corps and they really, really don't care, even if you win. Its literally like someone suing you for a $1 in their eyes.
