They're a lot better since the last warning and if I put in the ear plugs at 10 I don't hear the noise crescendo so I don't obsess about it.

Another development is realizing they also must have to have a 1br too considering they're directly above me. Which means dude iis illegally subletting.

Without the other dude I bet shit gets real quiet, and the guy moves. I emailed management but haven't heard anything back.

I don't think having a rooommate is subletting if the original person who leased the apartment is still living there. The person on the lease just assumes all responsibility for the apartment if they are the only one on the lease. They both could be on the lease, couples sign leases together for one bedrooms all the time.

His name isn't going to be on the lease and the complex requires the name to be on the lease if they are staying there

The complex will most likely just ask to add his name to the lease if that's the case. They aren't going to evict them for it.

They most likely would be happy to add him to it too. It gives them another person who is liable for any damages that they could go after if anything happens.

They're Brazilian and my money is on them not being here legally.
