So if marijuana was made legal at the federal level, you wouldn't be able to discriminate against it in the hire process. That is the point about legalizing it federally. Even if it is only legal for medical use.

You get caught with pain killers in your system, if you have a valid prescription, they cant refuse to hire you based upon that.

This isn’t true. There’s several companies that test for tobacco. Tobacco is 100% legal for anyone over 18. It’s terms of employment.

Right, Cleveland Clinic is a big one. But, if you are found with it, you’re not withheld from being hired, they actually attempt to assist you in stopping.

They don’t hire people that test positive. They give them a referral to a place that will help them quit from my understanding. I think UH has the same policy.

Another big one is Huntington bank.

Correct, mistype. Help quit for employees/applicant, no hire.

So just looked it up, in 30 of the 51 states/districts this practice is illegal, but not Ohio. Interesting.

I still say if you have a legal medication in your system you cannot discriminate. Like if you had a tooth pulled thus you took Vicodin for a few days, you could hire an attorney for illegal discrimination

That's for healthcare purposes, as smokers cost significantly more per month than non-smokers.

This wouldn’t be worth the effort, since marijuana isn’t chemically addictive like nicotine. Therapy can absolutely be useful for those who rely on marijuana as a crutch, however you can’t determine that from a simple positive test.
