I am telling you bro: guitar practice the minute quite hours are done. What’s that like 8AM? No way these people are done sleeping. Or put the speaker facing upward at the ceiling. Maybe attach a subwoofer to the ceiling, then throw Genuine’s “So Anxious” on loop.

They won’t last a day.

Hit me just as soon as your shift is ooooohhooover.

I had thought about bumping the thread to get updates, miss the entertainment factor it brings the rest of us. I figured it all calmed down after you busted their door in. :chuckle:

I thought they were moving out and you were moving in there?

They have apparently stayed. I'm writing the complex every night with updates and recordings now. I said by the end of the week if I haven't been able to sleep we all need to do the right thing and part ways or it's going to escalate again, guaranteed.

Didn't they offer to switch apartments with you? Also didn't you say their lease was almost up?

Just have them take over your lease when their lease is up and go find a small single house or guest house. I feel like you are going to have this problem again if you live in an apartment especially in San Diego. Almost all apartments and townhouses in SD I've been in, the floors and walls just allow sound to travel.

do they not have another unit somewhere you can move into?

also, I actually about fell out of my chair when you posted you busted their door in.

I'm glad someones enjoying it haha. No, nowhere to go.

I was woken up from a nap a few days ago bc a really hot ass girl was being super dirty in bed. "finally, I benefit from this bs"

I paused everything and got up to peer out over the window sill, and it was a homeless lady in the dumpster talking to herself erratically.

I bought am airhorn. I was not expecting it to be that fucking loud but my head was ringing for 5 minutes.

Been another 10 days straight of this. I cut my hand up last night banging on the ceiling and emailed pictures to the complex. I write them every day now and they finally respondrd. "I'm sorry you're having this issue I will ask maintenance to see if they can do something to dampen the noise"

"thanks Alanna. You work very hard and it's apparent you actually care about your job and this place, so there is no ill will towards yoi when I write the rest of this email.

Ive been dealing with this for 3 months and I need to set a definitive time line, I cannot keep doing this. If there isn't a sufficient resolution in place and practice by Monday I will need to move on and break the lease on terms of not being able to enjoy quiet living space.

Should Catalina Pacific not be willing to allow that I will open a civil claim for rent for the three months I have paid Catalina Pacific and not been able to enjoy a quiet living space. At the beginning and throughout those 3 months Catalina Pacific has been notified of this issue and been unwilling/unable to resolve this issue. I am immediately able to provide a handful of other tenants corroboration and months of audio recordings and a handful of reviews online supporting my argument that there is an unreasonable amount of noise and that the walls and ceilings are paper thin.

I know you aren't responsible for the complex you've inherited and there's only so much you can do but this is a nightmare. I pay too much money to not be able to sleep through literally a single night of the week. "

Have you considered fucking the guys wife/girlfriend? Break them up... cause chaos. When you do, make sure you break down the bedroom door, so he knows it was you. This of course risks you being shot, but you need to determine if your sleep or potentially a measly little bullet in your body is worth it.

Of course, if all else fails just fuck the biker chick before you move.

She moved.

Airhorn is worth it weight in gold.

There's a decibel meter app and it says every step is 60db. 45 is the limit in California for reasonable noise.

I'm buying a legit meter and making sure it's accurate and then taking them to court

taking who to court, the neighbors or the landlord? I assume the landlord, just confirming.

And who moved, the noisy neighbors, or biker chick?

Hard to keep up with all of the moving parts, but if either one moved, move into their place.

Yea landlord

I've been over these arguments a handful of times now and here's how I see it.

Tennants are allowed to talk and live in their own apartments At a reasonable noise level.

That is an entirely different issue than the fact that I'm entitled to enjoy a quiet living space. So in this case, both tenants rights are compromised. That is neither I nor the upstairs neighbors problem, it is the complexes. They are unable to provide both simultaneously. So while they're allowed to live in their apartment, that just means they can't be evicted. The other issue still remains an issue.

State of California actually has standards of noise level and landlord requirement. In writing they acknowledge the fact that noise as a detrimental effect on quality of life and can have significant impact on mental helsth.

Acceptable noise level changes at a level of 10 dB after 10pm, because hearing becomes more. Sensitive. That level is roughly 50 dB.

The wash machine is 65, the footsteps are 60 and they are all night long.

So I'm suing for 3 months back rent that I paid after informing the complex about this issue that they ultimately have noy and cannot solve. I am also suing to get out of my lease and for costs related to moving et.

If you’re using the air horn, then can’t they evict you for noise?
