So basically what this boils down to, and i think something you are missing is employees have rights. An employer just cant go around firing anyone they want because they dont like what they do in their personal time. Serious question if your boss called you up and fired you because he found out you masturbate at home on your own personal time, what would you do? You would be on the phone in an instant with a lawyer, and for good reason. Legality of what the employee did is what turns the argument from a messy lawsuit to an easy justification for firing someone, so thats why legality matters.

As far as your final question, as I said the dude is an absolute professional. No one that doesnt know this dude outside of work would think he is a sexaddict

The bolded isn't the case with Callaway, man. Have you read the article?

Dude was on his phone talking to/texting girls in the clubhouse before games, was spending a surprising amount of time hitting on chicks in the stands, and was sending dick pics from the locker room.

When you work in Baseball, and your peers are commenting on how sidetracked you are by women, that's awfully telling by itself.

You don't need evidence of a crime committed to fire an employee whose doing that stuff because it is negatively impacting the organization.

This thing is way past the question of "Did Callaway even do anything wrong?" It's very much at the point of "How much wrong did he do, and who knew about it before now?"

Interesting angle. I know I would get fired if my boss became aware of a photo in which I am sitting naked at my desk while wearing my company hat.. Why wasn't he fired?

I thought Soda was trying to say he was posing with the company sign (as in outside). I guess he just means with the company logo in the privacy of his own house?

I work in an office... The pic(s) in question were taken in a locker room... Jup posted at length about it in the other forum.

On June 19, 2016, during a season when Callaway would play an important role in helping the Indians reach the World Series, the woman who went on road trips with Callaway received a text message that included a shirtless photo from Callaway taken inside a clubhouse. He was wearing an Indians cap.

 
A few points (and I maybe missing something here as I don’t read athletic)

1) This came to Indians attention in Summer of 2017
2) Indians didn’t know about pic till after he was gone
3) He left for NY October 2017 (2 weeks after season ended)
4) Tito said he is not losing pitching coach between these 2 dates (sure he didn’t want a scandal right around playoff chase and 22 game win streak)
5) sounds like they fined him for the misconduct that they knew about - which wasn’t illegal based on what they knew
6) how long do inveštigations take? Even if they were investigating, would it have concluded within a month or two?

I don’t condone this behavior but I can see Indians dealing with affair and few things they knew about it by fining him and then focusing (investigating) on whether he should continue employment in 2018 after season. Yet, he left before player interviews were probably done and summarized.

Imagine if they cut Callaway in August 2017 during the streak and then collapsing in playoff run. The whole organization would have been crucified if all that happened was an affair and flirting/personal texting (remember nude pics came later). It’s easy to play armchair quarterback after it’s all laid out when it become obvious.
