Washington - President Bush has quietly claimed sweeping new powers to open Americans' mail without a judge's warrant, the New York Daily News has learned.

The president asserted his new authority when he signed a postal reform bill into law on Dec. 20. Bush then issued a "signing statement" that declared his right to open people's mail under emergency conditions.

That claim is contrary to existing law and contradicted the bill he had just signed, say experts who have reviewed it.

Bush's move came during the winter congressional recess and a year after his secret domestic electronic eavesdropping program was first revealed. It caught Capitol Hill by surprise.

"Despite the president's statement that he may be able to circumvent a basic privacy protection, the new postal law continues to prohibit the government from snooping into people's mail without a warrant," said Rep. Henry Waxman, D-Calif., the incoming House Government Reform Committee chairman, who co-sponsored the bill.

Experts said the new powers could be easily abused and used to vacuum up large amounts of mail.

"The signing statement claims authority to open domestic mail without a warrant, and that would be new and quite alarming," said Kate Martin, director of the Center for National Security Studies in Washington.

"The danger is they're reading Americans' mail," she said.

"You have to be concerned," agreed a career senior U.S. official who reviewed the legal underpinnings of Bush's claim. "It takes Executive Branch authority beyond anything we've ever known."

A top Senate Intelligence Committee aide promised, "It's something we're going to look into."

Most of the Postal Accountability and Enhancement Act deals with mundane reform measures. But it also explicitly reinforced protections of first-class mail from searches without a court's approval.

Yet in his statement Bush said he will "construe" an exception, "which provides for opening of an item of a class of mail otherwise sealed against inspection in a manner consistent ... with the need to conduct searches in exigent circumstances."

Bush cited as examples the need to "protect human life and safety against hazardous materials and the need for physical searches specifically authorized by law for foreign intelligence collection."

White House spokeswoman Emily Lawrimore denied Bush was claiming any new authority.

"In certain circumstances - such as with the proverbial 'ticking bomb' - the Constitution does not require warrants for reasonable searches," she said.

Bush, however, cited "exigent circumstances" which could refer to an imminent danger or a long-standing state of emergency.

Critics point out the administration could quickly get a warrant to search targeted mail, and the Postal Service could block delivery in the meantime.

I'm not too worried about it... I'm not hiding anything.... All they're gonna see from me is cell phone bills/car note... Nothing that makes me mad about this.

But I think it's a good idea to some EXTENT... But like they said, I'm sure it'll get abused and then some poor guys wife is gonna find out he's been visiting X-rated sites or something.

If there is people that they are concerned about, then go ahead... read their mail.

Not only is this pointless for anyone to get upset about...its pointless for them to really look through peoples mail.

All governemnt mail is put through a radiator and its all checked, so its not like this isnt a new concept.

They could care less what 99% of the 300M of us are doing. The purpose of this law is to save lives and prevent people from getting injured or killed by hazardous materials. They could care less about Nicky's phone bills or cdt's porn. They just don't want to wait for a warrant if there's something that presents imminent danger. Trust me unless you are doing something REALLY REALLY REALLY wrong...you have nothing to worry about. Well...maybe Jigo has to worry.:chuckles:

Them opening my mail means nothing to me. Hell, maybe they'll pay my bills for me... :chuckles:

People have no problem posting shit on there myspace, pictures and stuff you like, but people have a problem with people looking through their mail?

Exactly.

I do think it's a waste of time thought. I would think that someone wishing to do harm to the citizens of America would have another way of passing information other than the US postal service though.
 
My problem with this and other such moves by this admin is that when you start letting them violate your privacy and rights like this it slowly opens the door for more and larger invasions of privacy.

They can tap your cell phone at anythime w/o warrant.
They can arrest and detain you under the terrorist act and lock you up without trial as long as the see fit.
Now mail.
They slowly take them away one by one and that could get scary.
 
we live in scary times, but really, how many of the above apply to you? i know what your saying is under the whole principal of "what more will they do" im not doing anything illigal, let alone anything they would care about. believe me, they could really careless about what the hell your doing. and there isnt anything your doing that anyone could figure out about you through your myspace or any other things.

the whole thing that bugs me, is people who complain about this stuff, are the same ones saying we need to do stuff to better protect the country.
