I don't think you can or should fire the guy for this. A wild overreaction, in my opinion. It's a bit of an embarrassment for the organization so mandated counseling or whatever is appropriate.
I once attended a safety seminar in Canada where we did training for conducting BATs and UAs. It was the last session before adjourning, and it was held at the hotel where we were all staying. So as a demonstration at the end of the class they had several volunteers drink 2 Canadian Pilsners, 6% ABV. One other guy and one female and myself were selected. Didn't waste any time, we drank them right down. We then blew into the breathalyzer about 5 minutes after we were finished. This was on an empty stomach for all of us. The other guy blew (if I remember correctly) .07, the gal blew .09, and I blew .025. I had an associate who took the same class and he blew 0.00 so they let him drink 2 more and he still blew 0.00. Something about his metabolism, or IDK what. No doubt body weight was a factor, I was a pretty solid 240 at the time and the female was probably 110. I also just have a pretty high tolerance level, not sure how that's reflected in BAC.As someone mentioned earlier, much depends on what you drank. Eating with alcohol, as you do, can dramatically lower the effects as well.
I'm a 5'2" 135 lb woman. I consume about 2-5 drinks a week on average. On celebratory occasions, I try not to have more than 3 in a given day because 4 is considered binging for women (and with good reason -- hangovers are awful).
But I keep in mind ABV as well. An Oktoberfest beer is about 6% abv on average, but a mai tai is 12%. If I have two main tais, even if I've eaten a meal, I've drunk the equivalent of four beers. Heck to the no (fwiw, I did have two mai tais in an evening once -- never again ugh).
A lot of craft beer these days is more than the standard 5-6 abv as well. A typical ipa is 7% abv. A double ipa is 9-12%. One double ipa in a night is plenty for me, even with a meal.
Bottom line, people have to pay attention to how much food and drink has been consumed to determine the effects, and they also have to take into account their body size. Best bet is to always have a DD or taxi/Uber ready if you're unsure.

Still players and FO people KNOW what can happen if you're not responsible. No excuse. You let your guard down and you get into trouble. Can't tell your team what not to do, then you do it.I never understood how players and execs seem to always get DUIs. They have the money for Ubers and can just put their car into a park garage with overnight parking. In Koby's case, he most definitely has a reserved parking space at the arena that he could have just parked at.
I also wonder why teams don't have car services or someone in the organization on call to pick up and drop off players and execs. Like just add it into the job description of an overnight security guard or someone to be on call to pick up someone if they call.
Uber/Lyft was such a game changer for having a social drink. Most towns I lived in had terrible public transit systems. Cleveland, I'm looking squarely at you. It was either cut yourself off early or the tales of getting home would be the highlight of the night.

AZ is pretty tough, but a normal DUI is a max of 90 days for first offense (Extreme is .15), If you refuse, it is a 1 year suspended licesne. Funny thing is, they could get a search warrant for the blood test.
Its beatable, he wont get a dui, they didnt do the blood test, but no license for a year i think is mandatory in Oh because he refused and 3 days in jail.
But I dont think Altman gets the dui because there is no evidence.
The 3 days in jail also can be substituted with a 3 day driver alcohol intervention program. Those are usually like 3 days in a hotel and you got to do classes and stuff the whole time. You have to also pay for it and the hotel stay.
