Advocate seeks Ontario ban on Cleveland Indians logo, name

A prominent advocate for aboriginal peoples wants the Cleveland Indiansname and logo banned in Ontario.

Douglas Cardinal, an officer of the Order of Canada and a renowned First Nations architect, has an application before the Ontario Superior Court and complaints filed with the Human Rights Tribunal of Ontario and the Canadian Human Rights Commission saying the team name and logo is racist and discriminatory.

Chief Wahoo — a red-skinned, horse-toothed caricature used as a team logo — is disrespectful and discriminatory, the complaint says.

Cardinal has had enough, lawyer Michael Swinwood said.

“Canadian law clearly prohibits discrimination of this nature,” he said.

“It also violates my client’s right to equal treatment and the rights of indigenous peoples across Canada and everywhere else the name and logo are used.”

On Monday, there will be a hearing on Cardinal’s application before the Superior Court.

“Douglas Cardinal is also a baseball fan and he and people like him should not be subject to racial discrimination in the provision of a service, which is occurring in this case,” Swinwood said.

It’s a complicated legal matter with jurisdictional issues, said Renu Mandhane, chief commissioner with the Ontario Human Rights Commission.

“The issue is whether the team name creates a poisoned environment for indigenous people attending the game — when used in Ontario if it creates a barriers (for aboriginal people) accessing services at the Rogers Centre, and whether the mascot caricature incites discrimination,” Mandhane said.

Last week, Toronto Blue Jays president Mark Shapiro, a former executive with the Cleveland team for decades, said he was personally bothered by the Chief Wahoo caricature to the point he distanced himself from the logo.

Foe 20 years, Blue Jays play-by-play announcer Jerry Howarth hasn’t used terms like Braves or Indians as he feels they are disrespectful to First Nations communities.


Someone needs to let this ignorant man know that we are just honoring him.

It's amusing how so many people are "bored" of the topic. A generation down the line is going to be embarrassed for us that we used it for so long. Mark Shapiro just came out to say that it has always bothered him and was the main reason he pushed the block C logo so hard.

I'm actually pleasantly surprised that I haven't seen any red faces in the crowds. Seems like people are going with painting their faces like baseballs. Step in the right direction I suppose.
 
It's just time for this to go away. Name and logo. Go back to the Spiders - there's tradition there, and as noted, you could come up with some really cool logos and team uniforms. Win the WS, and announce the old name is going away.

But this world has become very soft and everything offends everybody. Even a cartoon character. My great grandmother was cherokee, which makes me a little, do I care?? Fuck no.

Our football team is named after a secondary color but Spiders just can't be taken seriously... The dumb stuff people tell themselves to continue to justify a name that will only become more controversial and more of a topic as time passes. The Indians have a choice- make a change while they still have the option or have it forced on them by embarrassing public opinion and/or law. The tide is just going to continue to rise.

Excuse me? Our football team isn't named after a color... try saying it's named after a fantastic, successful, Ohio born man who is responsible for a lot of things. Get your shit together.

Actually, I'm pretty sure our football team is named after a specific person. But that's besides the point.

No one is going to pass a law forcing us to rename our team. Also, a full rebrand of a team costs a few million dollars, considering how much would have to be replaced around the park and elsewhere. Dolan has no incentive to do that, unless the team was moving or something. I also happen to think Chief Wahoo is one of the most iconic logos in all of sports, mainly because of how immediately identifiable it is to our baseball team.

Once again I say, this is only offensive if people choose to make it offensive. We're not "making fun" of anybody. Give it a rest.

Will be a sad day in this country if that ever happens. And I would imagine that would be the stance of most people on both sides of the chief.

Once again, this is NOT how things work. I get it that "nostalgia" is very pervasive. That's frankly the only reason we're even having the discussion. It's not about what you want the logo to mean. It's about what the logo is. People shrugging it off or saying that it's an annoying topic doesn't make the topic any less important or the logo any less embarrassing.

It's crazy how pointing out blatant racism is being spun as sensitive and liberal. Can't tell you how many people I've observed in my circle and out that were against any change whatsoever and eventually had that "a-ha moment". Once it clicks in your head, it's a wrap. Zero to do with sensitivity.

Like, I love this team and want to rock the logos. It's not fun going against the grain with hometown sports and having to avoid the merch. There's a reason more and more people are discussing this and bothered by the branding. It's not because it's a blast doing it.
 
I really wanna buy some Indians gear; especially now... I'm hoping to get some jerseys for me and my wife (she's a Dodgers fan).

But I can't wear/buy/support Chief Wahoo....

Hear's to hoping they change it this offseason..
