Sometimes when Bauer pops up on my youtube feed, he’s pitching to HS kids.

So here is the MLB 2018 Code of Conduct policy (before updating to 2022)

"Sexual assault refers to a range of behaviors, including a completed nonconsensual
sex act, an attempted nonconsensual sex act, and/or nonconsensual sexual contact.
Lack of consent is inferred when a person uses force, harassment, threat of force,
threat of adverse personnel or disciplinary action, or other coercion, or when the
victim is asleep, incapacitated, unconscious or legally incapable of consent."

Here is the California code on consent and sex... taken from a previous post of mine (but I am not a lawyer, just play one on a forum).

So CATs, after further investigation, you are right on continuous capable of consent in California (stricter rules than other states due to another case). But there is one key piece missing in that Bauer knew or should have reasonably known that she was unconscious during the act. Her being intoxicated and slurring her words would be reasonable. Rule states


“4) Where a person is at the time unconscious of the nature of the act, and this is known to the accused. As used in this paragraph, "unconscious of the nature of the act" means incapable of resisting because the victim meets any of the following conditions:
(A) Was unconscious or asleep.
(B) Was not aware, knowing, perceiving, or cognizant that the act occurred.
(C) Was not aware, knowing, perceiving, or cognizant of the essential characteristics of the act due to the perpetrator's fraud in fact.
(D) Was not aware, knowing, perceiving, or cognizant of the essential characteristics of the act due to the perpetrator's fraudulent representation that the sexual penetration served a professional purpose when it served no professional purpose.”


As Jup would say, if police or woman had a recording or police listening in, to this knowing her legal team would most likely have presented it via recording or affidavit already versus just her word that he admitted it (not enough) to change it from consensual from her text messages.

And, it’s different if he realized later that she was unconscious. I did even see some testimony explaining how she was going in and out of consciousness and supposedly quotes of questioning her own knowing if scratches and her bruises on face occurred while she was unconscious or not.
Thus, as said before -- did Bauer know she was unconscious (going in and out of conscious state) and the "person uses force" is vague as that eliminates almost of whole category of sex whether previously agreed to or not with safe words or not.

On June 30, 2021, the Pasadena Police Department confirmed to news outlets that Bauer was under investigation for the alleged assault of a San Diego woman that May.[115] The woman was granted a temporary domestic violence restraining order on June 28, alleging that she had met Bauer on April 21 and that she had been physically and sexually assaulted by him on two separate occasions.[116] The woman alleged that Bauer had sodomized her without consent,[117] punched her in the face, and choked her to the point of unconsciousness.[118] On May 16, she went to the emergency room at Alvarado Hospital, where, after her injuries were examined, she met with several detectives from the San Diego Police Department.[116] MLB placed Bauer on administrative leave on July 2, while the Dodgers removed his merchandise from their team store and replaced his scheduled bobblehead promotional night with a Clayton Kershaw "World Champion T-shirt" promotion.[119] Bauer has acknowledged having sexual contact with his accuser, but has stated that their encounters were "'wholly consensual'"[118] and that his accuser sent him a text message requesting that he inflict pain upon her; he has denied certain specific aspects of the allegations.[117] Bauer underwent a civil hearing for the restraining order against him from August 16 to August 19.[120] Bauer did not testify during the hearing.[121]

On August 20, the temporary restraining order against Bauer was removed after a judge determined that Bauer did not pose a threat to the woman's immediate safety.[122] MLB extended his leave for the remainder of the season while they and the Pasadena Police Department finished their investigation into Bauer.[123] On February 8, 2022, the Los Angeles County District Attorney's Office announced that they would not be filing any criminal charges against Bauer related to these incidents citing a lack of evidence.[124] In March 2022, Bauer filed defamation lawsuits against Deadspin, The Athletic, and a former reporter for The Athletic, Molly Knight.[125][126] The following month, he filed a defamation suit against the woman who had accused him of assault and one of her attorneys.[127][128] On September 13, 2022, Bauer, through his attorney as part of a motion to dismiss his accusers' lawsuit, released a video recorded by his accuser the morning after the alleged assault took place. Bauer's attorney claims the video proves his innocence showing his accuser "willingly in bed with a sleeping Mr. Bauer, and is smirking and uninjured".[129]

While Bauer was under investigation in 2021, The Washington Post uncovered court records showing that a separate woman from Ohio had sought a temporary order of protection in June 2020. Police reports indicated that the woman had accused Bauer of physical assault in 2017 and that she had sought an order of protection after receiving death threats from the pitcher.[130] Bauer denied these additional allegations and further alleged that he had been harassed and physically assaulted by the Ohio woman.[131] During MLB's investigations, a third accuser came forward who alleged abuse during his time with the Indians.[132]

It’s one of the weirdest youtube accounts I’ve ever seen, and my son is 8 and likes to watch “video game playthroughs.”
 

Hopefully most Bauer talk is limited to this thread and not ten pages back and forth on the main Guardians offseason thread

He has served 162 of it, so the Dodgers have to decide if they are keeping him or going to cut him and the 28 million left on the deal. This is a huge decision since they cannot get out of that money...

I don’t think he’s going to pitch for the Dodgers.
Maybe a trade to the Mets? Lol
